FSHRMPS Preconference Workshop: Promoting Collaboration Between Risk Management and Defense Counsel Using a Mock Jury Experience

The Florida Society for Healthcare Risk Management and Patient Safety (FSHRMPS) in partnership with the Florida Defense Lawyers Association (FDLA) is proud to offer this educational program aimed at increasing collaboration between the risk manager and defense counsel prior to a claim and or potential litigation. This mock jury workshop will provide risk managers with the opportunity to observe a segment or summarized version of a case to a jury made up of a group of participants similar in demographics to a potential jury pool. Mini surveys and straw ballots are used throughout the process to monitor jurists’ responses. The mock jurists will hear closing arguments and go through deliberation, immediately followed by a focus group led by a skilled moderator. Thes focus group will identify valuable insights for both the risk manager and defense counsel by uncovering key drivers motivating jurors' findings of guilt / innocence, or damages due.

The case to be presented will involve allegations of negligence against the nursing staff and the physicians that resulted in neurological injury, hypovolemic shock and acute kidney failure to a baby during labor and delivery. The allegations against the nursing staff include failure to timely communicate with physicians, failure to properly evaluate fetal monitoring strips and failure to establish a plan of care for the patient. The allegations against the physicians include failing to timely educate the patient and instruct her to have an emergent c-section, failing to proper supervise OB/GYN residents, failing to properly evaluating fetal monitoring strips, and attempting a vacuum delivery three times. Additionally, there are allegations that there was insufficient communication between the nursing staff and the operating room to promptly perform an emergent c-section.
