The FDLA Amicus Committee Files a Brief Regarding Worley v. Central Florida YMCA

The FDLA amicus committee, through Caryn Bellus of Kubicki Draper in Miami has filed an amicus brief in the Florida Supreme Court Case of Worley v. Central Florida YMCA. The case involves the the ability of defendants to explore through discovery the referral relationship between a Plaintiff's treating physician and the Plaintiff's attorney. FDLA Urges The Daubert Standard To Florida Supreme Court

The FDLA submitted comment to the Florida Supreme Court in April urging the Court to accept the Daubert standard in the State and harmonize the the Florida Evidence Code with the Federal Rules of Evidence. Check back here for more information as it becomes available.

Issue: The issues presented in this consolidated appeal involve the application of the Asbestos and Silica Compensation Fairness Act ("ASCFA") to claims of various plaintiffs and whether requiring a plaintiff to actually suffer physical impairment prior to filing suit violates due process.
Status: FDLA filed an amicus brief in support of Appellant on August 20, 2009. Oral argument is set for February 10, 2010.
