Defense attorneys in Florida need to understand what it means, and how it affects claims handling and litigation, when the Florida Supreme Court declines to adopt a statute “to the extent it is procedural.” There are many misconceptions about the legal significance of such decisions, and the impact they should have on the way claims are adjusted and the way cases are litigated in Florida.
